Ariel to Face Trial for Distribution of Sex Videos

Jakarta - Prosecutors have thrown the book at pop star Nazril “Ariel” Irham, charging him in relation to two pornographic videos allegedly featuring himself and television celebrities Luna Maya and Cut Tari.

Attorney General’s Office spokesman Babul Khoir Harahap said the Peterpan frontman had been charged under Article 29 of the 2008 Anti-Pornography Law, the 2008 Information and Electronic Transaction Law (ITE), Article 56 of the Criminal Code for “participating in a crime” and an obscure emergency law passed over a half-century ago.

The 1951 law states that if an act is considered a crime but cannot be shown to be a crime according to existing laws and the Criminal Code, then hukum adat (customary law) is applicable.

Under the ITE Law, those convicted of distributing pornography can be jailed for up to six years, while the Anti-Pornography Law stipuates a maximum sentence of 16 years.

Babul said Ariel would not be indicted for his participation in the video clips, in which he allegedly filmed himself in the act with Cut Tari, the former model and host of Indonesian gossip show “Insert,” and his girlfriend, Luna Maya, the former face of Lux soap and a one-time presenter on a popular music show.

“No one knows exactly where and when the video was shot. Cut Tari said it occurred at a hotel in Indonesia, some said it happened in 2005, while others said 2006 or even 2010,” Babul said.

Cut Tari has also been charged under the 1951 law because the videos were allegedly filmed before the pornography legislation was enacted, while Luna’s case remains unclear.

Ariel will be indicted based on his role in distributing the graphic pornographic movies.

Supporters have argued that the trio were victims of theft and should not be punished.

“But a witness account confirmed that Ariel played a role in the distribution of the sex video and from this perspective, we do have a case,” Babul said.

A key witness identified only as Reza or Redjoy had told police that he received the video files from the Capung Studio belonging to Ariel in Antapani, Bandung, and the witness prepared them for distribution on the Internet.

“The fact is that Ariel was involved in the distribution. He knew about [it] but he didn’t do anything to prevent it from being distributed,” Babul said.

“And the crime scene is clear. It was obviously Bandung.”

Ariel has been transferred from National Police headquarters to the Bandung Prosecutor’s Office for trial in the capital of West Java, where the offenses allegedly occurred.
